Legal profession is one of the oldest profession and was practiced in one form or the other in the hoary past. There are two contradictory approaches with regard to legal profession in ancient India. The first approach denies existence of any such institution and is headed by P. Varadachariar and Professor Ludo Rocher. The other view supports the idea of the existence of legal profession in ancient India. K.P. Jayaswal is the main exponent of this approach. It also finds support from Julius Jolly and the Dean of Dharamsastra, Dr. P.V. Kane. H.H. Wilson, A.C. Ganguly and N.D. Basu admit that there were people who functioned as lawyers during the Mughal period, through their functions and duties were not clearly defined as during the pre-Mughal and post-mughal periods.

The modern legal profession has emerged from the constition of curts and legislative anactments initiated by the British in India. In order to give effect to some recommendations of the Indian Bar Committee, 1923, the Indian Bar Coun cil Act was enacted in 1926. The main purpose of the Act was to provide for the constituion and incorporation of Bar Council for certain courts, to conform were made to improve the efficiency of legal profession. In this process, in 1951, the All India Bar Committee was constituted under the Chairmanship of Justice S.R. Das. The committee considered at length questions of constitution and powers of the Bar Council and made detailed recommendations in 1953. These recommendations got strength by the endorsement and approval of its recommendaion by the Law Commission of India which was constituted on 5" August, 1955. The Report of the Commission was submitted in 1958 and bill with a view to give effect was introduced in 1959 in the Parliament and this ushered in the promulgation of the Advocates Act of 1961.
