Arbitration of small claims can go long way towards relieving trial calender congestion and eliminating delay in the disposal of pending cases. Potentially, a state of country can create as many abritration tribunals as the case load warrants. Thus, existing delay in adjudication of minor claims may be virtually eliminated. Furthemore, the removal of small claims from trial court calenders will "free courts" for the speedier performance of other judicial function, "paving the way for quicker adjudication of the larger claims. Section 89 of the Code of Civil Procedure (as amended in 2002) permits judicial officer to direct the settlement of small clamins through arbitration and the 1996 enactment governing arbitration in India applies. The case comes back only for the enforcement of award.
